Mattress Firm, Inc. and its brands, including Sleep Experts and Sleep.com (collectively, “Mattress Firm,” “we,” “us” and “our”), are committed to making your search for the perfect mattress and a great night’s sleep as pleasurable and easy as possible. Maintaining your privacy is part of that commitment. By interacting with Mattress Firm through our stores, websites, customer service desk, MattressMatcher® application, mobile applications, events, products, and services, you expressly consent to the collection and use of your personal information as described in this Privacy Notice. We may change or add to this Privacy Notice, so we encourage you to view it periodically. This Privacy Notice is made available to you for information purposes only and is not a contract between you and Mattress Firm.
What is Not Covered by this Privacy Policy?
If you applied for a Mattress Firm credit card or any other financing or leasing online or on your mobile device, this Privacy Notice does not apply to information that you submitted in your application, which was collected by a third-party on behalf of our financing and leasing partners, not Mattress Firm. These partners have their own privacy policies, which we encourage you to review before you submit your application. You may contact our financing and leasing partners directly for information on their privacy policies and for detail on how they use your personal information.

Our stores, websites, applications, events and services are intended for general audiences only and are not directed at persons outside of the United States or at children less than 18 years of age. We do not knowingly collect personal information from persons outside of the United States or from children under 18 years of age.

How Do We Collect Your Information?
We may collect your personal information in the following ways:

  • Directly from you. When you, visit our websites, stores, or events; register with, or create an account on, our websites or applications; if you use any of the MatressMatcher® or DreamHub™ application in any of our stores, events or online; if you use our Sleep.com mobile app and show our Sleep Experts any of your sleep tracking results on your mobile app; respond to a survey given by or on behalf of us; buy products or services from us, whether online, in-store or at one of our events; contact us by phone, e-mail, online chat, webform or mail; file a warranty claim or return or exchange a product; participate in a sweepstakes or similar promotion sponsored by, or in partnership with, us; sign-up to receive emails or text messages from us; leave comments or reviews on our websites, or post a photo or other content or send us a message via our channels on social media platforms like Facebook, Instagram, and Twitter


  • Through use of cookies and automated technologies that we have installed on our website and our other digital content that links to this Privacy Notice. For more information on our use of cookies and similar technologies, please review the “Cookies and Tracking Technology” section below;


  • From third parties. We may obtain your personal information from third-party sources, such as marketing and advertising partners, service providers, your friends and family, and social media companies.
Types of Personal Information We Collect About You

During the past year, we have collected the following information about our guests and others. We may collect such information about you:

  • Identifiers, such as name, postal address, telephone number, and other information necessary to provide you with our services. We disclose this information to Advertisers and Marketers, Service Providers, Financing and Leasing Partners, and Suppliers.
  • Characteristics protected under law¸ such as your date of birth and gender in order to better understand you and provide you with a tailored experience on our services. We disclose this information to Service Providers.
  • Commercial information, such as records of products or services purchased, net worth, income, and other service-related financial information. We disclose this information to Advertisers and Marketers, Service Providers, Financing and Leasing Partners, and Suppliers.
  • Internet or other electronic network activity, such as browsing time, search history, and information regarding your interaction with websites, applications, or advertisements. We disclose this information to Advertisers and Marketers, and Service Providers
  • Non-Specific Geolocation Data, as inferred from your IP address. We disclose this information to Advertisers and Marketers, and Service Providers.
  • Inferences, such as your SleepScore® and other profiles we create in order to provide you with tailored versions of our services. We disclose this information to Advertisers and Marketers, Service Providers, Financing and Leasing Partners, and Suppliers.

We may also disclose the above categories of information to Government Authorities, Law Enforcement and Collection Agencies, and other third parties as required by law.

Some of the above information may be Sensitive Personal Information, such as your Driver’s License and credit card number. We use Sensitive Personal Information for legitimate business purposes, including to (i) perform services or provide goods reasonably expected by an average person; (ii) detect security incidents; (iii) resist malicious, deceptive or illegal actions; (iv) ensure the physical safety of individuals; (v) for short-term, transient use; (vi) perform or provide internal business services; or (vii) verify or maintain the quality or safety of a service or device. We do not sell or share any Sensitive Personal Information.

Cookies and Tracking Technology

We use tracking tools, such as clickstream data, cookies and pixel tags, to collect personal information from you. You may disable some of these tracking tools by managing your cookie preferences on your internet browser; however, if you choose to use our website, you expressly consent to the use of those tracking tools, including performance and functional cookies, that are necessary for the proper functioning of our websites and cannot be disabled.

  • Clickstream Data. We collect clickstream data, which provides a non-personalized record of your activity on the internet using the items and webpages that you click on. We use this data to analyze how you use our websites.
  • Cookies. We collect cookies, which are small text files that may be stored on your device when you use our websites. The cookies we use may contain information – such as a unique user ID – or collect information, such as your IP address or if you create an account with us on any of our websites, email address. Cookies allow us to recognize your device when you return to our website. They also help us to understand how you use our website and to provide you with advertising and content that we think may be of interest to you.
  • Pixel Tags. A pixel tag (also known as a web beacon) is a small string of code that represents a clear graphic image. We use pixels to collect non-personalized information about your activity on our website (e.g., time, date, duration, and number of page views), so that we can improve our website functioning and to provide you with advertising and content that we think may be of interest to you.

We allow third-party companies (e.g., Google and PayPal) to place tags on our digital properties. The tags may collect information about your activity on our websites and may be used by these third-parties to provide us with data and marketing analytics, to assist us with creating or effecting advertising campaigns, and to assist with order fulfillment. Our Privacy Notice does not cover these third-party companies’ data practices. Please contact these third-party companies (e.g., Google and PayPal) directly for more information about their privacy policies and your choices regarding the tags and the information collected by the tags.

Facebook Custom Audience Ads

We may display interest-based ads to you when you are using Facebook through a tool offered by Facebook called the Custom Audience Tool. This tool allows us to personalize our ads based on your shopping experience with us. The tool lets Mattress Firm convert your e-mail address to a unique number that Facebook uses to match to unique numbers Facebook generates from e-mail addresses of its users.

Google Custom Match Ads

We may display interest-based ads to you when you are using Google through a tool offered by Google called the Custom Match Program. This tool allows us to personalize our ads based on your shopping experience with us. The tool lets Mattress Firm convert your e-mail address to a unique number that Google uses to match to unique numbers Google generates from e-mail addresses of its users.

Token-ID Based Targeting

When you use our website, we share information that we collect from you, such as your email address, phone number, IP address or information about your browser or operating system, with our identity partners/service providers. These partners return an online identification code that we may store in our first-party cookie for our use in online, in-app, and cross-channel advertising and which may be shared with advertising companies to enable interest-based and targeted advertising.

Some web browsers have “Do Not Track” or similar features that allow visitors to tell each website they visit that they do not want their activities on that website tracked. There is no uniform standard for implementing and recognizing “Do Not Track” signals. For that reason, at present, our websites do not respond to “Do Not Track” signals.

E-mail Marketing

If you are opted in to receive marketing e-mails from us and wish to unsubscribe, you can do so by clicking on the Unsubscribe hyperlink at the bottom of the marketing e-mail you receive. You may also choose to opt out of e-mails by sending an e-mail to us at customerservice@mattressfirm.com. If you choose to opt out with this method, please be sure to include the e-mail address that you would like us to unsubscribe.

SMS and Text Messaging

You may have the opportunity to receive occasional voice, text and SMS messages from us. These are updates on our products and services, or about products and services that we think may be of interest to you. Frequency will vary. By providing your phone number and opting in to receive text messages, you expressly consent to receive these communications. This includes automated text messages to the phone number that you provide. Consent to receiving text messages is not required to receive products or services from us. Message and data rates may apply, and your carrier's rates will apply. You can opt out of receiving future text messages or receive help by following the directions in the text message you receive. As we are in the United States, international rates may apply depending on your location. We may disclose your mobile phone number to service providers with whom we contract to send you automated text messages. However, we will not disclose your mobile phone number to third parties for their own marketing purposes without your express consent. Opting out of calls, texts and SMS messages does not mean that we will not contact you about your account.

How Do We Use Your Personal Information?

During the past year, we have used information that we have collected about our guests and others for the following business purposes. We may use the information that we collect about you for the following business purposes:
  • To provide you with our goods and services including: completing your purchase and creating a record of your sales order; accepting and processing payment; delivering products to you, and providing you with rewards and compensation for participating in contests or studies.  We also may use your personal information to resolve chargebacks, disputes and errors relating to your finance or lease account.
  • So that we can market and advertise to you. We use your personal information to send you communications about special promotions or offers via regular mail, email and text messaging. We may send you emails if you register on our website or mobile application, Sleep.com, if you create (or allow us to create for you) a DreamHub™ profile, or if you give us your personal information in one of our stores or pop-up events. We may use personal information about you collected across different online services and non-affiliated websites and from the various devices you may use, to market to you (including by online ads) based on your interests. For example, if you view a product on our website, you may see ads for that product on our or third-party websites. We also use your personal information collected from our MattressMatcher® application, Sleep.com mobile application, financing partners and data and analytics partners to make product, service and content recommendations to you. We may use your personal information across all of our brands (e.g., Sleep Experts, Mattress Firm, and Sleep.com).
  • So that third parties and affiliates can market to you. We may disclose your personal information to third parties who may use the information to market our goods and services or their goods and services to you based on your purchases or interactions with us.
  • To provide you with customer service (e.g., warranty claims, exchanges, returns, store locator, answering your questions, etc.) and otherwise communicate with you.
  • To detect and prevent fraud and criminal activity, to comply with legal obligations, respond to legal proceedings, and to administer our loss prevention program. We may also use cameras in our stores to administer our loss prevention program.
  • To conduct internal research and data analytics. We may use personal information collected about you to conduct research for purposes of improving our merchandising, sales, marketing, customer experience and real estate strategies and to evaluate our performance. We may use personal information collected about your behavior on our websites and applications and your purchase history to make improvements to our websites, applications, stores and our product and service offerings.
  • If you are a vendor or landlord that is a natural person, we collect your personal information so that we can verify your payment information, report payments that we make to you to the applicable taxing authority (e.g., IRS) and to remit payment to you. If you win a prize under a sweepstakes that we sponsor, we may collect your tax identification number to report your winnings to the applicable taxing authority.

How Do We Disclose Your Personal Information?

We may disclose personal information that we collect about you for our business purposes and as legally required or permitted. In the past year, we may have disclosed your personal information to the following categories of third-parties:
  • With our Service Providers.
    We may disclose personal information that we collect about you to companies that provide us with services in support of our ongoing operations. For example, we allow our fraud prevention vendor to collect personal information about your activity on our websites, as well as personal information you may provide at checkout, to detect and prevent fraud. We may also disclose personal information about you with payment processors, delivery routers, contractors and schedulers, shippers, product suppliers, product order processors, technical service vendors, companies that conduct surveys on our behalf, and companies, like direct mail providers, that help us market our products and services. These companies must agree to appropriate restrictions on the protection and use of your personal information.
  • With our Advertisers and Marketers.
    We may disclose your personal information to advertising and marketing partners to provide you with targeted advertising and promotions and to enable you to give us feedback about the products that you purchase from us. Certain advertising partners may de-identify, aggregate or pseudonymize your data in order to provide you with personalized advertising and for their own analytics.
  • With our Financing and Leasing Partners.
    We may disclose your personal information to our financing and leasing partners to prescreen you for financing and leasing offers that we may communicate to you. Also, if you purchase a product from us using your Mattress Firm credit card or other financing or leasing applied for in-store, online or at one of our pop-up events, we inform the applicable finance or leasing company of your sales order information. We may also disclose your personal information to resolve chargebacks, disputes, errors and fraudulent activity associated with your financing or leasing account.
  • With our Suppliers.
    In instances where we do not administer a product’s warranty, we may provide your personal information to the supplier of the product so that your warranty claim can be handled. We may also disclose personal information to our suppliers to respond to your reviews and questions about their products and services. If a supplier is responsible for directly shipping an ordered product to you, we provide your order and contact information to the supplier so that the product can be delivered to you. If you purchase a service contract or extended warranty from us, we provide your sales order, name and contact information to the provider or administrator of the service contract or warranty so that they can activate your service contract or extended warranty.
  • With Government Authorities.
    We may disclose your personal information as required or requested by a governmental agency (e.g., to respond to a court order or subpoena and report payments to applicable taxing authorities).
  • With Law Enforcement and Collection Agencies.
    We may disclose your personal information as we believe to be necessary or appropriate: (i) under applicable law, which may include laws outside your country of residence; (ii) to comply with the request of a law enforcement or regulatory agency (including agencies outside your country of residence) or other legal process; (iii) to protect our operations or those of any of our parent company, subsidiaries or affiliates (collectively, “the Affiliated Entities”); (iv) to protect the rights, privacy, property, interests or safety of Mattress Firm, the Affiliated Entities, website visitors, customers, business partners, employees or the public; (v) to permit us to pursue available remedies or limit the damages that we may sustain; (vi) to enforce our Terms of Use; or (vii) to respond to an emergency.
  • With Strategic Business Partners.
    As we continue to develop our business, we or our affiliates may sell or buy other businesses or entities. In such transactions, your personal information may be one of the transferred business assets or provided in connection with due diligence for the transaction.
  • At Your Direction.
    We may disclose your personal information as requested by you.

Security of Personal Information

We have implemented technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be entirely secure.
How Long Do We Keep Your Personal Information?

We keep your personal information as long as we reasonably anticipate needing it to comply with applicable law, to enforce our rights and to support our ongoing business relationship with you, in accordance with our policies. As an example, if you have purchased a product from us, we anticipate that we may need your personal information to:

  • Meet your reasonably anticipated customer service needs (e.g., providing copies of sales receipts and responding to questions that you may have regarding the merchandise and services that you ordered).
  • Assist you with any current or future warranty claims. Please note that the products that we offer often come with warranties that last several years from the date of original purchase.
  • Process returns and/or fulfill exchanges.
  • Contact you in the event of a product recall or other issue relating to the product or services that you have purchased.

So that we may continue to market and advertise to you, we will not remove you from our marketing list unless you unsubscribe from all marketing communications from us or ask that we delete your personal information from our records.

Third Party Services

Our websites and applications may contain references and/or links to third-party websites and services, including references and links to third parties that accept and process your payments and credit applications to us. We are not responsible for any third party’s data collection or privacy practices, and we have no control over what information third parties track or collect. Any access to and use of such linked websites is not governed by this Privacy Notice but instead is governed by the privacy policies of those third-party websites. We encourage you to review the privacy policies posted on those third-party websites for further information.

Notice Regarding Use of out Services by Children

Our services and the website are not directed to children under the age of eighteen (18), and we request that children do not provide personal information through the website or any other services we provide. If we learn that personal information from users less than 18 years of age has been collected, we will take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under age 18, please contact us at Consumer.Privacy@mfrm.com.
Changes to this Privacy Notice
We may occasionally update this Privacy Notice to reflect changes in our practices. When we post modifications to this Privacy Notice, we will revise the “Last Updated” date at the top of this Privacy Notice. If the changes are material, we will endeavor to notify you in advance of such changes taking place to the extent required by law by email to the last email address that we have on record for you.

We may use and disclose personal information for the business and commercial purposes detailed in the “How Do We Use Your Personal Information?” and “How We Disclose Your Personal Information?” sections of the Privacy Notice.

We do not sell personal information for monetary consideration. However, some of our disclosures to third-parties may be considered a share or sale under California law. We have sold or shared the following categories of personal information with targeted advertising service providers and partners, data brokers, and merchandise suppliers: Internet or other electronic network activity information, Identifiers, and Commercial information. We do not knowingly sell the personal information of minors under 18. Your California Rights

If you are a California resident, you may have the following rights with respect to the personal information we process about you:

  • Right to Know. You may have the right to request information about the categories of personal information we have collected about you, the categories of sources from which we collected the personal information, the purposes for collecting, selling, or sharing the personal information, and the categories of third-parties to whom we have disclosed your personal information, and the specific pieces of personal information we have collected about you.
  • Right to Delete. You may have the right to request that we delete personal information that we have collected from you.
  • Right to Correct. You may have the right to request that we correct inaccurate personal information that we maintain about you.
  • Right to Opt out of Sales or Sharing. You may have the right to opt out of the “sale” or “sharing” of your personal information as such terms are defined by the California Consumer Privacy Act.
  • Right to Non-Discrimination. Should you choose to exercise any of these rights, we will not discriminate against you in any way. If you exercise certain rights, understand certain features of our website and mobile applications may be unavailable to you.
Exercising Your California Rights

You can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable law.

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g. phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If, however, we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity, and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

Consumer Privacy Rights

You may have the following rights, subject to any applicable exemptions or limitations:

  • Right to Access. You have the right to confirm whether we are processing your personal information and to access such personal information.
  • Right to Correct. You have the right to request that we correct inaccurate your personal information that we maintain about you.
  • Right to Delete. You have the right to request that we delete your personal information under specific circumstances.
  • Right to Opt out. You have the right to object or opt out of certain types of processing, including: (1) processing for the purpose of targeted advertising, (2) processing for the purpose of the sale of personal information, and (3) processing for the purpose of certain types of profiling and automated decision-making.
  • Right to Data Portability. You have the right to request a copy of your personal information in an accessible format.
  • Right to Equal Service. If you choose to exercise any of these rights, we will not discriminate against you in anyway. If you exercise certain rights, understand that you may be unable to use or access certain features of our websites, services, or properties.
  • Right to Appeal. If we do not grant your consumer request, you may have the right to appeal that denial.

Submitting a Privacy Rights Request

If submitting a written request, please include your name, mailing address, telephone number and email address. Making a consumer request does not require you to create an account with us. Applicable law may limit the number of times that you can submit a particular request within a 12-month period.
